Who Sends the Record?

The District Court.

What is it?

  • Detailed instructions (PDF)
  • The Record on Appeal contains:
    • The documents filed in the case,
    • Any exhibits from the hearing/trial, and
    • Any transcritps.

Why is this needed?

  • An appellate court may not consider any new facts. 
  • It must rely solely on the facts that were presented to the District Court. 

When will this happen?

  • Within 63 Days of the Notice of Appeal.
  • The Record will not be sent if:
    • You failed to complete one of the steps in the checklist.
