Moving the Trial Date

Requesting that the Trial Date be Moved

To request that the trial date be moved, you may file a general motion form explaining to the court why you need the date to be changed. Moving the court date to a later date is called a continuance. The magistrate will generally grant a continuance for you to prepare a defense to a defendant’s counterclaim or to get a lawyer if the defendant has one. Continuances may also be requested to subpoena witnesses, obtain evidence, or negotiate a settlement or for pre-planned trips or family or medical emergencies.

The court may also move the trial date if:

  • You do not serve the defendant properly or do not serve the defendant at least 15 days before the trial date;
  • You do not sue the proper individual, company, or entity; or
  • Too many cases want to have a trial on the same day.
