Garnishee Has Debtor’s Property

When the garnishee answers, if they DO have possession or control of judgment debtor’s property then the court will order the garnishee to deliver the property to the sheriff to be sold.

The sheriff will pay proceeds from sale in to the court registry.

The clerk can disburse money to you from the registry without further order of the court.  The clerk can disburse up to amount necessary to satisfy judgment to judgment creditor, with any excess to judgment debtor.
