When can I sue in small claims court?
In order to sue in Small claims court, you have to meet the following requirements.
- I am suing for $7,500 or less.
- I am not suing for defamation by libel or slander, eviction, or injunctive relief or a matter regarding probate, mental health, divorce, or custody. Read Colorado Revised Statutes §§ 13-6-105 & 13-6-403 for more information (see below for links to laws).
- The defendant is:
- an individual and lives, works, or is a full-time student in the county where I plan to file,
- OR, the defendant is a company or entity with an office for the transaction of business in the county where I plan to file,
- OR, I am suing for a security deposit or to enforce a restrictive covenant and the property is located in the county where I plan to file. Read Civil Procedure for Small Claims Court, Rule 503 for more information (see below for link to rule).
I understand that the court will not collect any money for me and that I may never get any money even if I win my case.
