Creating a Power of Attorney

(1) Delegation of Power by Parent or Guardian Pursuant to §15-14-105, C.R.S

  • The parent or guardian of a minor or incapacitated person may sign the Delegation of Power by Parent or Guardian.
  • Authority about the care (including medical and dental), custody, education, recreation and property of the minor or incapacitated person is given to the person named as the “Attorney in Fact” on the document and on the date set forth in the document.
  • This power of attorney is only valid for 12 months.
  • The form is JDF 751.

(2) Statutory Form Power of Attorney Pursuant to C.R.S §15-14-741

  • This power of attorney allows another person to make decisions concerning your property for you. The person is called your “Agent” and will be able to act for you and make decisions for you whether or not you are able to act for yourself.
  • This power of attorney does not allow the agent to make healthcare decisions for you. You need a separate medical durable power of attorney for that. (see #3).

(3) Medical Durable Power of Attorney

  • A medical power of attorney allows you to name a person to be your agent. This person will make health care decisions for you when you are not able to do so.
  • You can give specific instructions about various issues like surgery, medical treatment, and more. 
  • A few examples of this form are provided below since there is no form provided by a Colorado Revised Statute. Usually, the form is called a Medical Durable Power of Attorney for Health Care Decisions.
