Can I Appeal?

Not all orders can start an appeal.

1.  Final Order

  • To appeal, you must have a:
    • Written, signed, and dated order.
    • This order resolves the last of the questions that brought you into court.

2.  Right Court

  • With only a few exceptions, a District Court case is reviewed by the Colorado Court of Appeals.

3.  Right Time

You must start the appeal within:

  • 49 days of the final order being issued. 
  • See Number 1 above.

Post-Trial Relief

  • Sometimes called a Motion for Reconsideration.
  • 49 days of an order deciding this Motion.
    • The Motion is due within 14 days of the final order.
    • Untimely motions do not extend the period to appeal.

Magistrate Review

  • 49 days of an order deciding a Magistrate Review.
    • A magistrate review is due within 14 days of a final order.
    • If the review is filed late, the Court of Appeals cannot hear the appeal.
