Not all orders can start an appeal.
1. Final Order
- To appeal, you must have a:
- Written, signed, and dated order.
- This order resolves the last of the questions that brought you into court.
2. Right Court
- With only a few exceptions, a District Court case is reviewed by the Colorado Court of Appeals.
3. Right Time
You must start the appeal within:
Final Order
- 49 days of the final order being issued.
- See Number 1 above.
Post-Trial Relief
- Sometimes called a Motion for Reconsideration.
- 49 days of an order deciding this Motion.
- The Motion is due within 14 days of the final order.
- Untimely motions do not extend the period to appeal.
Magistrate Review
- 49 days of an order deciding a Magistrate Review.
- A magistrate review is due within 14 days of a final order.
- If the review is filed late, the Court of Appeals cannot hear the appeal.
